Application of Consumer Guarantees Act
Where the Consumer Guarantees Act 1993 (CGA) applies to the purchase of your vehicle, 2 Cheap Cars’ obligation is to ensure that the vehicle you are purchasing is of acceptable quality.
A vehicle will be of acceptable quality when it:
- is fit for all the purposes it would normally be used for;
- has no major or minor faults;
- is acceptable in appearance and finish;
- is safe to use; and
- is durable.
When deciding whether a vehicle is of acceptable quality, the following factors are taken into account:
- the type of vehicle;
- the distance the vehicle has travelled;
- the vehicle’s age;
- the vehicle’s engine size;
- the price paid for the vehicle; and
- any information provided about the condition of the vehicle.
In the unlikely event the vehicle you have purchased is not of acceptable quality as outlined above, it is important that 2 Cheap Cars has the first opportunity to remedy the problem. You do not need to get your car checked by an independent mechanic before you bring it to us. Doing so may affect your right to a remedy.
Claims procedure
So we can efficiently assess your claim and, if eligible, remedy any defects, we have put the following process in place:
- Please download the Claims Form from our website and follow the instructions. You will be asked to provide details of the issues you are having with the vehicle you purchased and submit the form to our claims department.
- One of our claims assessors will then review your Claims Form and aim to contact you within 3 working days.
- If our claims assessors consider 2 Cheap Cars may be responsible for rectifying the issues you are experienc-ing with your vehicle, they will direct you to one of our designated repair facilities for further assessment and, if eligible, the defect will be remedied at no cost to you. If 2 Cheap Cars has an obligation to remedy a defect with your vehicle under the CGA, we will:
- repair the vehicle at our cost; or
- where the vehicle is beyond repair, either replace or provide a refund for that vehicle; and
- otherwise meet our obligations under the Act.
So that we can determine whether we must remedy a defect with your vehicle it is important that an assessment is undertaken by one of our designated inspectors.
Please note that the CGA is not the same as a mechanical warranty and we are not obligated to remedy defects if:
- the issues with your vehicle are the result of normal/day to day wear and tear; or
- our salesperson advised you of a problem with the vehicle in writing before you purchased the vehicle; or
- the issue you have with the vehicle has been caused by your misuse or neglect of the vehicle
